Does My LLC Need an EIN to Purchase Florida Real Estate?

Yes. Your LLC needs an Employer Identification Number (EIN) — also called a Federal Tax Identification Number — to purchase Florida real estate. The title company requires it for tax reporting purposes.


What Is an EIN?

An EIN is a 9-digit number assigned by the IRS to identify a business entity for tax purposes. It is the business equivalent of a Social Security number.


Why the Title Company Requires It

The title company uses the LLC's EIN for:

  • IRS Form 1099-S reporting: The title company is required to report real estate transactions to the IRS. For entity buyers, the EIN is used for this reporting.
  • FIRPTA compliance: If the seller is a foreign national, the buyer (or the title company on the buyer's behalf) may need to withhold and remit funds to the IRS. The EIN is needed for this process.

How to Get an EIN

Apply online at the IRS website (irs.gov/businesses/small-businesses-self-employed/apply-for-an-employer-identification-number-ein-online). The process takes approximately 10 minutes and the EIN is issued immediately.

Requirements:

  • The LLC must already be formed (you need the LLC's legal name and formation date)
  • The person applying must have a valid Social Security number or ITIN
  • Applications are available Monday–Friday, 7 a.m. to 10 p.m. Eastern time

Single-Member LLCs

A single-member LLC that is disregarded for tax purposes (the most common structure for individual vacation rental owners) still needs an EIN for real estate transactions. Even though the LLC's income is reported on the owner's personal tax return, the EIN is required for the closing.

No. The IRS does not charge a fee for EIN applications.

How long does it take to get an EIN?

If you apply online, the EIN is issued immediately. Paper applications take 4–6 weeks.

Can I use my Social Security number instead of an EIN for the LLC?

No. The title company requires the LLC's EIN, not the owner's Social Security number.
