A title search is an examination of the public record history of a property to confirm that the seller has clear, marketable title and to identify any liens, encumbrances, or defects that could affect the buyer's ownership. It is one of the most important steps in a Florida real estate transaction.


What a Title Search Examines

The title company searches public records — typically covering the last 30–60 years of ownership history — including:

County property records: Deeds, mortgages, satisfactions of mortgage, and other instruments recorded with the county clerk.

Court records: Judgments against the property owner, lis pendens (notice of pending litigation), and foreclosure proceedings.

Federal tax lien records: IRS tax liens attach to all property owned by the taxpayer.

State tax lien records: Florida Department of Revenue liens.

HOA and condo association records: Unpaid assessments and association liens.

Probate records: If the property passed through an estate, the title company verifies that the transfer was properly handled.

A title search examines the public record — but not all title defects appear in the public record. Title insurance protects against:

  • Forged deeds or fraudulent transfers that were recorded but are legally invalid
  • Errors and omissions in the public record
  • Claims by heirs or other parties that were not discoverable from the public record
  • Survey errors that affect the property's boundaries

Even after a clean title search, title insurance provides protection against defects that were not discoverable from the public record.
