Rental eligibility is determined by the condo declaration, the HOA rules and regulations, and local ordinances. The restrictions vary dramatically from building to building, and buying a condo without verifying rental eligibility is one of the most expensive mistakes a Destin buyer can make.

1. The Condo Declaration

The declaration is the foundational governing document, recorded in the public record. Rental restrictions in the declaration are the most durable — they require a supermajority vote (typically 75–100% of all unit owners) to amend.

What to look for:

  • Minimum rental period (nightly, 7-day, 30-day, or longer)
  • Maximum number of rentals per year
  • Owner-occupancy requirements
  • Prohibition on rentals entirely
  • Tenant registration or approval requirements

Red flag language: "No unit may be rented for a period of less than 30 days" or "Units may only be used for residential purposes by the owner" are declaration-level restrictions that eliminate short-term rental income.

2. HOA Rules and Regulations

Rules and regulations are adopted by the board and can be amended more easily than the declaration. They address operational details of rentals — registration requirements, tenant conduct rules, parking, pool access for renters.

Rules and regulations can restrict rentals beyond what the declaration requires, but cannot expand rental rights beyond what the declaration allows.

3. Local Ordinances

City of Destin: Destin has a vacation rental registration ordinance requiring all short-term rental properties to register with the city and comply with occupancy, noise, and parking standards.

Okaloosa County: Properties in unincorporated Okaloosa County (outside the city limits of Destin) are subject to county vacation rental regulations. Verify which jurisdiction applies to the specific property.

Sandestin: Properties within Sandestin are subject to Sandestin's master covenants in addition to the individual building's declaration and the applicable county ordinances. Sandestin's master covenants include rental provisions that apply community-wide.


Destin Condo Rental Categories

Full STR buildings: The declaration explicitly permits short-term rentals with no minimum stay or a minimum of 1–3 nights. These buildings are designed for vacation rental use and typically have on-site rental management programs. Most Gulf-front condo towers in Destin fall into this category.

Restricted STR buildings: The declaration permits rentals but imposes minimum stay requirements (7 days, 14 days, or 30 days). A 7-day minimum significantly reduces the number of bookings available during shoulder season and eliminates the highest-rate nightly bookings during peak season.

Owner-occupancy or long-term rental only: The declaration prohibits short-term rentals or requires minimum stays of 30+ days. These buildings are not viable vacation rental investments. They may be appropriate for primary residence buyers or long-term rental investors.

Condo-hotels: Condo-hotel units are typically required to participate in the hotel's rental program when the owner is not in residence. The rental program terms — management fee, blackout dates, owner use restrictions — are set by the hotel operator, not the individual owner.


Sandestin-Specific Rental Rules

Sandestin's master covenants include rental provisions that apply to all properties within the community. Individual building declarations may impose additional restrictions. Buyers considering Sandestin vacation rental properties must review both the master covenants and the individual building declaration.

Sandestin has historically been more permissive of short-term rentals than many comparable resort communities — but the master covenants do impose minimum stay requirements and registration obligations. Verify current requirements with the Sandestin Community Association before purchasing.


How to Verify Rental Eligibility
